What Happens if I Win My Appeal?

In most situations, if you win your appeal, you case will be "remanded." This means the case will be sent back to the trial court or judge responsible for your conviction and/or sentencing. If the case is remanded, you might:

  • Receive a new trial on the criminal charges;
  • Be given the chance to negotiate a plea bargain;
  • Be given a new sentencing hearing (note: the court of appeals will ask the judge to adjust the sentence so that its legal and/or that meets the terms of a plea agreement);
  • Although it is rare, some appeals do result in the appellant being released from jail or prison.
